Function

The Class Proceedings Committee (the “Committee”) decides which class actions receive funding from the Class Proceedings Fund (the “Fund”), after applications made by plaintiff.  The Fund is self-funding.   If the Committee awards funding and the case is ultimately successful, the Fund receives 10 % of the award or settlement. If funding is awarded and the defendant is successful then the Fund pays costs orders made in that proceeding. 

Membership

The Committee is composed of, (a) one member appointed by the Law Foundation of Ontario (the “Foundation”); (b) one member appointed by the Attorney General; (c) three members appointed jointly by the Foundation and the Attorney General.

Term

Each member of the Committee shall hold office for a period of three years and is eligible for re-appointment.

Meetings
The Committee meets monthly, or more often as necessary.
Remuneration

The members of the Committee shall serve without remuneration, but each member is entitled to compensation for expenses incurred in carrying out the functions of the Committee.
