Roles and Responsibilities

The Building Code Commission (the Commission) is an adjudicative tribunal whose mandate is to hold hearings and make decisions to resolve disputes between affected parties concerning the sufficiency of compliance with the technical requirements of the Building Code.  The Commission also holds hearings and makes decisions regarding time period disputes for site inspections and time period disputes for processing permit applications.

The mission of the Commission is to provide a fair, impartial and timely appeals process for resolution of disputes relating to the technical, construction, and time period requirements of the Building Code.

A member is responsible for the resolution of disputes among parties appearing before the Commission, pursuant to the Building Code Act, 1992 (the Act), by adjudicating hearings and rendering decisions. A member may carry out this responsibility alone as a single adjudicator, or as part of a panel in accordance with the statutory authority set out in the Act and the Building Code.

 

Key Duties

Prepares for and participates in hearings, makes rulings and writes timely and well reasoned decisions.

Participates in hearings or other duties as assigned by the Chair in accordance with the Act and the Building Code, as well as within the policies, procedures and rules of practice developed by the Commission.

Actively listens to and comprehend positions of parties and poses questions to parties, if necessary, in order to clarify positions of parties and understanding of the dispute.

Reviews and analyzes the evidence and submissions thoroughly, and participates in making decisions based on the evidence and application of the Act and the Building Code.

Attends and participates in meetings of the Commission, as well as participating in work groups related to the work of the Commission, as requested.

Qualifications

Members are required to have the following abilities, skills and knowledge in order to carry out their responsibilities effectively:

  • Comprehensive knowledge of the Act and the Building Code, an understanding of the provincial building regulatory system, and related laws and legal processes.
  • Relevant experience and expertise in one or more of building design and standards, engineering, architecture, building materials manufacturing, testing and industry standards.
  • Technical expertise in one or more of the following areas: architectural design, structural design/engineering, fire safety, building sciences and standards, mechanical design/plumbing, and on-site sewage systems.
  • Demonstrated analytical, conceptual, problem-solving, decision-making and writing skills.
  • Ability to listen and communicate clearly and effectively.
  • Ability to formulate and write well reasoned decisions. Experience considered an asset.
  • Impartiality and sound judgement to fairly assess cases involving issues regarding conflicting verbal or written evidence.
  • Availability and willingness to attend and participate in hearings.

NOTE:  Individuals who are in the public service of Ontario or an employee of a municipality or Registered Code Agency are not eligible to serve as members of the Commission.

Appointment is by Order-in-Council for an initial period of two years. Please note that the appointments are subject to renewal for a maximum of ten years, in a given position, upon the recommendation of the Chair.

The Building Code Commission holds hearings on an as needed basis – generally not more than once every two weeks. Typically, a member would be requested to sit as a member of a hearing panel about once every two months. The Building Code Commission holds two all-member meetings a year.

Commission members receive remuneration in the form of a per diem at rates established by Treasury Board/Management Board of Cabinet. Members may receive a per diem up to $550.00 depending on length of meeting and number of hearings. Commission members are also reimbursed for out-of-pocket expenses associated with attending Commission hearings in Toronto, in accordance with Ministry of Municipal Affairs and Housing and Ontario Public Service guidelines.
