The Workplace Safety and Insurance Appeals Tribunal (“WSIAT” or “Tribunal”) offers a challenging opportunity for a proven workplace safety and insurance professional to serve as a Full-Time Vice-Chair.
The WSIAT is a highly specialized adjudicative tribunal, which hears appeals from final decisions of the Workplace Safety and Insurance Board (WSIB) and applications to decide whether a worker has the right to sue for personal injury in Court.

As a Full-Time Vice-Chair, you will adjudicate appeals brought by parties to the Tribunal pursuant to Workplace Safety and Insurance Act, 1997 (WSIA). Specifically, you will be required to:
- Prepare for and conduct hearings or reconsiderations, and make rulings on evidence and procedure in accordance with applicable legislation and Tribunal procedures and rules of practice;
- Review all evidence and render decisions that are independent and free from outside influence, on the basis of evidence and submissions, often involving complex medical and legal issues;
- Write and issue well-reasoned decisions in a timely manner; and
- Apply excellent judgement and demonstrate a sound knowledge of administrative law principles to a variety of hearing formats involving unrepresented parties and parties with varying types of representatives.
It should be noted that hearings may vary in length and complexity and may be oral, written, electronic or in-person.

- Qualifications
The Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009 provides that all appointments shall be made through a competitive, merit-based process, with criteria for appointments that include:
- Experience, knowledge or training in the subject matter and legal issues dealt with by the tribunal.
- Aptitude for impartial adjudication.
- Aptitude for applying alternative adjudicative practices and procedures that may be set out in the tribunal’s rules.
In addition, a successful candidate will possess the following:
- Expert knowledge of the Workplace Safety and Insurance Act, 1997 (WSIA), the workplace safety and insurance system and related law;
- Understanding of the justice system, administrative law and the concepts of fairness / natural justice;
- Understanding of the professional, institutional and community context within which WSIAT operates;
- Knowledge of medical issues and terminology;
- Demonstrated analytical, conceptual, problem-solving and writing skills;
- Ability to objectively and fairly assess cases involving difficult issues regarding conflicting verbal/written evidence and the assessment of credibility; self-confidence;
- Ability to listen and communicate clearly and effectively;
- Good organization skills;
- Good interpersonal skills;
- Tact, sensitivity to nature of issues on appeals;
- Well-developed dispute resolution skills;
- Computer literacy and ability to work in a paperless and digital environment, including conducting virtual hearings and managing and editing electronic appeal related documents; and
- Commitment to respect diversity, and to take inclusionary approaches in maintaining fair, transparent processes that meet high professional standards.

In addition to hearings, Full-Time Vice-Chairs will be participating in tribunal meetings, committee work, training and mentoring sessions. - Expenses

Annual remuneration for the position of a Full-Time Vice-Chair is set at $159,154 per year in the first-term (2 years). Appointees will receive reimbursement for reasonable expenses incurred in carrying out tribunal duties in accordance with the relevant directives, guidelines and policies of the Treasury Board and Management Board of Cabinet. Expenses are subject to review by the Integrity Commissioner of Ontario and will be posted on the Workplace Safety and Insurance Appeals Tribunal public website.
