The Health Services Appeal and Review Board (HSARB) is seeking candidates who are interested in being appointed as a part-time Public Member.
The HSARB is an independent quasi-judicial tribunal, established by the Ministry of Health and Long-Term Care Appeal and Review Boards Act, 1998 to conduct hearings and related proceedings under twelve different health care statutes. The decisions being appealed to or reviewed by the Board include:
- Decisions of the Ontario Health Insurance Plan (“OHIP”) under the Health Insurance Act respecting eligibility for OHIP coverage and payment for services, and physician payment review applications;
- Orders of suspension under the Immunization of School Pupils Act;
- Decisions of approved agencies under the Connecting Care Act, 2019 regarding eligibility for and amount of community services;
- Orders of the Medical Officer of Health or public health inspectors under the Health Protection and Promotion Act;
- Orders and decisions of the Director under the Fixing Long-Term Care Act, 2021;
- Decisions of the Director under the Integrated Community Health Services Centres Act, 2023 with respect to licensing of independent health facilities.
The public member is responsible for the adjudication of disputes among parties appearing before the Board pursuant to the governing legislation by using a variety of dispute resolution methods including facilitation and adjudication of disputes and the rendering of decisions. The member is also responsible for compliance with the Board's Code of Conduct and Ethics Plan for members of the Board. The member may carry out this responsibility alone as a single adjudicator or as part of a panel.
The public member:
- Prepares for and conducts hearings or reviews, makes rulings and/or writes decisions and performs other duties as assigned by the Chair, in accordance with the governing statute and other applicable laws as well as within the policies, procedures and rules of practice developed by the Board.
- Hears submissions and evidence and/or information presented by the parties to a dispute, and ensures that all issues are dealt with at the hearing or review.
- Actively listens to comprehend interests and positions, which are sometimes difficult to ascertain.
- Makes rulings necessary for the proper and expeditious conduct, control and completion of the case conference, hearing or review.
- Reviews and analyzes all evidence, submissions, and/or information thoroughly and makes decisions based on the evidence and/or information and considers and applies relevant law.
- Makes rulings and issues written decisions that are independent and free of outside influence.
- Writes decisions in a timely manner, as established by the Member’s Code of Conduct.
- Writes clear, well-written, soundly reasoned decisions, which are understandable.
- Where the parties agree or where the law permits, facilitates a resolution between the parties and where directed to do so by the Chair, acts as a facilitator among parties by listening to the parties’ positions, defining underlying issues and interests, and focusing the parties’ attention on what a workable settlement would be.
- May participate in case conferences to define and clarify issues in dispute.
- May identify opportunities to resolve the dispute or specific issues in the dispute before moving on or continuing with a hearing or review.
- Participates in initial training and stays current in the field by engaging in ongoing professional development, participating in scheduled and ad-hoc meetings of the Board and its members, as well as participating on committees and working groups related to the work of the Board.
- Participates in meetings of the Board, and when requested to do so by the Chair or the Chair’s designate, in training and mentoring sessions and in committees established for the administration of the Board's role. From time to time, a member may be asked if they are willing to travel.
- Complies with policies and practices set out by the Board to meet financial accountability and administrative requirements.
- Works constructively and contributes to a collegial atmosphere at the Board by sharing knowledge, time and experience with other Board members.
- Maintains positive, productive and appropriate relationships with stakeholders and all parties appearing before the Board.
- Adheres to the Public Service of Ontario Act, 2006 (PSOA), specifically Part IV (Ethical Conduct), Part V (Political Activity) and Part II (Rules for Former Public Servants who worked in a Ministry) of Ontario Regulation 381/07 (the Regulation) of the PSOA.
- Ensures equal access, fair treatment and due process in dispute resolution and hearing and review practices.
- Deals with conflict and diverging interests while maintaining decorum, due process, and professional and respectful interactions among all participants.
- Recognizes and deals appropriately with situations that may involve an issue of bias or conflict of interest in accordance with the Board's Code of Conduct, Ethics Plan and Conflict of Interest Rules.
- Acts with integrity and honesty. Actions are guided by the best interests of the Board and the public.

- Qualifications
The Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009 provides that all appointments shall be made through a competitive, merit-based process.
Public members are required to have the following abilities, skills and knowledge in order to carry out their responsibilities effectively:
- Understanding of the professional, institutional and community context within which the HSARB operates;
- Demonstrated understanding of the justice system and administrative law and the concepts of procedural fairness/natural justice;
- Demonstrated analytical, conceptual, problem-solving, decision-making and writing skills;
- Ability to listen and communicate clearly and effectively;
- Ability to formulate reasoned decisions and communicate them orally and in writing in a timely manner;
- Ability to work collaboratively with HSARB Members and staff;
- Excellent interpersonal skills with a proven track record of conducting oneself professionally and with a high standard of integrity and ethical behaviour;
- Impartiality and sound judgment to fairly assess cases involving issues regarding conflicting verbal/written evidence and/or information and in the context of hearings, the assessment of credibility;
- Commitment to ongoing professional development to enhance expertise and remain current in the field;
- Good organizational skills to manage a diverse workload with complex, ongoing processes;
- Self-confidence/self-control and sensitivity to the diverse interests of all parties in order to maintain effective control in confrontational and stressful situations;
- Commitment to respect diversity, and to maintain fair, transparent processes that meet high professional standards;
- Ability and willingness for travel throughout the Province; and
- Computer literacy.
Although not mandatory, a thorough understanding of medical practices would be an asset.

Public members are eligible to receive $472 per day. Appointees will receive reimbursement for reasonable expenses in accordance with the Management Board of Cabinet's Travel, Meal and Hospitality Expenses Directive.
