The FST is seeking a select number of applicants with adjudicative and regulatory expertise to assign to hearing panels in licensing/market conduct/pension administration proceedings arising from regulatory action taken by the Financial Services Regulatory Authority of Ontario (FSRA).
In accordance with the Agencies and Appointments Directive, government appointments will respect the needs of the entity to which the appointments are made while also reflecting the diversity of the people of Ontario and the need to deliver services and decisions in a professional, ethical and competent manner.
Members will preside over hearings/pre-hearings/motions alone or as a member of a multi‑person panel. Writing well-crafted and timely reasons for decisions is an integral part of the adjudication function. Members will also be required to attend and participate in FST member meetings and provide other related services as determined at the request of the Chair of the FST.
- Qualifications
Members need not be lawyers. However, members must be able to interpret and apply relevant legislation, understand administrative law concepts, fairly assess the credibility and reliability of evidence, act impartially, independently and with an open mind, and listen actively to and communicate clearly with persons appearing before the tribunal, whether represented or not and in electronic, in-person and written format.
To carry out their responsibilities effectively, a member must also be able to:
- Act with integrity and honesty while prioritizing the best interests of the FST’s mandate and the public,
- Demonstrate an aptitude for impartial adjudication,
- Apply alternative adjudicative practices and procedures that may be set out in the Tribunal’s rules,
- Possess excellent writing skills,
- Prepare clear, well-reasoned decisions that consider the evidence, law, policy, and submissions,
- Commit to ongoing professional development to enhance expertise and remain current in the field,
- Work comfortably with computers and digital documents,
- Travel and allocate the necessary time,
- Show commitment to public service and the FST’s mandate/work, and
- Show commitment to high ethical standards and personal/professional excellence.
Members must have an advanced understanding of administrative law, the adjudicative process, and one or more of the following acts:
- Pension Benefits Act,
- Insurance Act,
- Mortgage Brokerages, Lenders and Administrators Act, 2006,
- Loans and Trust Corporations Act,
- Credit Unions and Caisses Populaires Act, 2020,
- Co-operative Corporations Act, and
- Prepaid Hospital and Medical Services Act.

Meet as required
Members preside over hearings (in-person, electronic and written), participate in ongoing professional development, and attend quarterly and special committee meetings. Upon joining the Tribunal, members must complete an in-house orientation program, requiring approximately 2 days. New members are expected to complete the Society of Ontario Adjudicators and Regulators/Osgoode PD Certificate in Adjudication, requiring approximately 35 hours (5-day course) and Intro to Decision Writing (1-day course). Pre-hearing conferences are typically less than 2 hours; however, members must allocate additional time for preparation beforehand and drafting formal orders in a written memorandum afterward. Simple hearings typically require one day of hearing time, while more complex matters can span over several weeks. Preparation and decision-writing time will vary depending on the complexity of the file. A member will spend approximately 40-45 days per year on hearing preparation, attendance, deliberation, and decision writing. - Expenses

Eligibility for travel, meal, and hospitality expenses in accordance with the Travel, Meal and Hospitality Expenses Directive. All expense claims to the FST are subject to relevant oversight and approval requirements. Per Diem – Paid by the Tribunal in accordance with Schedule B of the Agencies and Appointments Directive (currently set at $472/day).
