Roles and Responsibilities

The Agriculture, Food and Rural Affairs Appeal Tribunal is an adjudicative agency of the Ontario government established under the Ministry of Agriculture, Food and Rural Affairs Act. Its purpose is to hear appeals and other matters under 17 statutes related to agriculture in Ontario. Most appeals or applications arise from grievances under the Drainage Act, the Ministry of Agriculture, Food and Rural Affairs Act (arising from appeals of decisions made under the Farm Products Marketing Act or the Milk Act), the Assessment Act (related to properties in the farm land class), Agricultural Products Insurance Act, the Farm Registration and Farm Organizations Funding Act, 1993, and the Farm Implements Act.

As a Member of the Agriculture, Food and Rural Affairs Tribunal, you will be working in panels of two or three members, you will be required to hear submissions and evidence provided by parties, actively listen and comprehend the issues under appeal, review and assess the submissions and evidence thoroughly, and make and write timely decisions based on the evidence with consideration to the relevant legislation.

Members are responsible for the resolution of matters among parties appearing before the agency, pursuant to the governing legislation under which an appeal, complaint, application or dispute is filed, by providing a fair and impartial hearing and rendering a decision on a timely basis.

Qualifications

Knowledge and Experience:

  • Applicants for the position of a Member of The Agriculture, Food and Rural Affairs Appeal Tribunal should have an agri-food/processing background with experience in farming and knowledge in at least one or more agricultural commodities such as: dairy production and/or processing, chicken/poultry production and/or processing, cash crops, vegetable and fruit crops, livestock, or farm implements, and have an aptitude for impartial adjudication.
  • Experience in interpreting and applying legislation with specific knowledge of the agency's governing Act and related law.  Understanding of the context within which the agency operates.
  • Understanding of the justice system and administrative law and the concepts of fairness / natural justice.

  • Demonstrated analytical, conceptual, problem-solving, decision-making and writing skills.
  • Ability to listen and communicate clearly and effectively.
  • Ability to formulate reasoned decisions and communicate them orally and in writing in a timely manner.
  • Well-developed adjudication skills. Impartiality and sound judgement to fairly assess cases involving issues regarding conflicting verbal / written evidence and the assessment of credibility.
  • Commitment to ongoing professional development to enhance expertise and remain current in the field.
  • Good organizational skills to manage a heavy workload with complex, ongoing processes.
  • Self-confidence / self-control and sensitivity to the diverse interests of appellants in order to maintain effective control in confrontational and stressful situations.
  • Commitment to respect diversity, and to maintain fair, transparent processes that meet high professional standards. Computer literacy. Ability and willingness to travel.

The initial appointment term is up two years, with eligibility for a reappointment of up to three years, and a final reappointment for a term of up to five years, upon the recommendation of the Chair.

Members appointed as part-time members of the Agriculture, Food and Rural Affairs Appeal Tribunal will be expected to hear approximately two to five appeals a year, with additional time required to prepare for the hearing and draft decisions in a timely fashion as per the Tribunals’ guidelines and relevant legislation. The Tribunal has shifted to virtual hearings.

The part-time member position receives a per diem rate of $472 and is reimbursed for eligible expenses consistent with government directives and policies.
