Roles and Responsibilities

The Government of Ontario offers a challenging opportunity for an experienced labour and employment lawyer to serve as a full-time Vice-Chair of the Ontario Labour Relations Board.

As a full-time Vice-Chair, you will adjudicate employment and labour relations-related matters under numerous Ontario statutes. You will conduct hearings in accordance with applicable legislation, rules of evidence and the Board’s Rules of Procedure and render timely and well-written decisions that are independent and free of outside influence. Under the leadership of the Chair, you will contribute to the Board by participating on committees and other initiatives to monitor issues and trends and to ensure the Board remains responsive and effective, as well as mentoring new appointees.

The Ontario Labour Relations Board is an independent, adjudicative tribunal which plays a fundamental role in the labour relations regime within Ontario. It has a mandate to provide excellence in administrative justice through the effective resolution of a wide range of labour relations and employment disputes. The Board mediates and adjudicates disputes under the Ontario Labour the Relations Act, the Employment Standards Act, Occupational Health and Safety Act, the School Boards Collective Bargaining Act, Public Sector Labour Relations Transition Act and numerous other labour and employment statutes.

Qualifications

The Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009 provides that all appointments shall be made through a competitive, merit-based process, with criteria for appointments that include:

  • Experience, knowledge or training in the subject matter and legal issues dealt with by the tribunal.
  • Aptitude for impartial adjudication.
  • Aptitude for applying alternative adjudicative practices and procedures that may be set out in the tribunal’s rules.

In addition, a successful candidate will possess the following:

  • Experienced labour and employment lawyer or adjudicator with a minimum of several years experience;
  • While not a requirement for the position, prior experience in practising construction labour relations law and knowledge of the construction industry is considered a significant asset;
  • Experience in other relevant areas of law that are applicable or translatable to the tribunal’s work such as administrative law, human rights law, public sector law, occupational health and safety law, civil litigation and alternative dispute resolution, may also be valuable.
  • Extensive knowledge of the legislation under the Board’s jurisdiction and related laws and legal processes, the Board’s practices and procedures or the ability to acquire such knowledge;
  • Superior dispute resolution and analytical skills to resolve complex labour relations matters involving multiple interests under public scrutiny;
  • Ability to act as a neutral adjudicator including the ability to communicate and write clear, fair and impartial decisions in a timely manner;
  • Ability to adjudicate in French is not required, but would be an asset;
  • Commitment to respect diversity;
  • Computer skills.

Appointment is by Order in Council for an initial period of up to two years and is subject to renewal for a maximum of 10 years in a given position, upon the recommendation of the Chair.

Remuneration for the position of full-time Vice-Chair is set at an annual rate of $136,545 in the first-term (2 years). Appointees will receive reimbursement for reasonable expenses incurred in carrying out Board duties in accordance with the relevant directives, guidelines and policies of the Treasury Board and Management Board of Cabinet. Expenses are subject to review by the Integrity Commissioner of Ontario and will be posted on the Ontario Labour Relations Board public website.
