The Workplace Safety and Insurance Appeals Tribunal (“WSIAT” or “Tribunal”) offers a challenging opportunity for a proven workplace safety and insurance professional to serve as a Full-Time Member Representative of Workers.
The WSIAT is a highly specialized adjudicative tribunal, which hears appeals from final decisions of the Workplace Safety and Insurance Board (WSIB) and applications to decide whether a worker has the right to sue for personal injury in Court.
The WSIAT is committed to fostering and sustaining a diverse, inclusive, equitable and accessible workplace.
As a Full Time Member, you will sit on three person panels (i.e. a Vice Chair, a Member representative of employers and a Member representative of workers) and adjudicate appeals brought by parties to the Tribunal pursuant to the Workplace Safety and Insurance Act, 1997 (WSIA)
Member representatives prepare for and assist in conducting hearings and in making rulings and/or reaching decisions. Members make determinations from the evidence and arguments presented at the hearing, comment on draft decisions taking into consideration such factors as evidence presented, existing legislation, WSIB policy, and tribunal case law. Where the Member disagrees with the majority decision, he/she will prepare written reasons for dissent.
It should be noted that hearings may vary in length and complexity and may be oral, written, electronic or in-person.

- Qualifications
The Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009 provides that all appointments shall be made through a competitive, merit-based process, with criteria for appointments that include:
- Experience, knowledge or training in the subject matter and legal issues dealt with by the tribunal.
- Aptitude for impartial adjudication.
- Aptitude for applying alternative adjudicative practices and procedures that may be set out in the tribunal’s rules.
In addition, a successful candidate will possess the following:
- Expert knowledge of the Workplace Safety and Insurance Act, 1997, the workplace safety and insurance system and related law;
- Understanding of the justice system, administrative law and the concepts of fairness/natural justice;
- Understanding of the professional, institutional and community context within which WSIAT operates;
- Demonstrated analytical, conceptual, problem-solving and writing skills;
- Knowledge of medical issues and terminology;
- Ability to objectively and fairly assess cases involving difficult issues regarding conflicting verbal/written evidence and the assessment of credibility; self-confidence;
- Ability to listen and communicate clearly and effectively;
- Good organizational skills;
- Good interpersonal skills;
- Tact, sensitivity to nature of issues on appeals;
- Well-developed dispute resolution skills;
- Computer literacy and ability to work in a paperless and digital environment, including participating in virtual hearings and managing and editing electronic appeal related documents;
- Commitment to respect diversity, and to take inclusionary approaches in maintaining fair, transparent processes that meet high professional standards;
- Proficiency in English.
A Member Representative of Workers generally has background or experience relevant to the perspective of the worker community.
The WSIAT is actively seeking candidates who are able to conduct hearings, communicate as necessary and adjudicate in French.
Bilingual (French and English) candidates are strongly encouraged to apply. Successful bilingual candidates may undergo an assessment to determine language proficiency and ability to deliver French Language Services.

Appointment is by Order in Council for an initial period of up to two years and is subject to renewal for a maximum of 10 years in a given position, upon the recommendation of the Chair. - Time Commitment

Meet as required
Full-time Members are scheduled for hearings. In addition to hearings, Members will be participating in tribunal meetings, training and mentoring sessions. - Expenses

Annual remuneration for the position of Member is set at $128,776 in the first-term (2 years). Appointees will receive reimbursement for reasonable expenses incurred in carrying out tribunal duties in accordance with the relevant directives, guidelines and policies of the Treasury Board and Management Board of Cabinet. Expenses are subject to review by the Integrity Commissioner of Ontario and will be posted on the Workplace Safety and Insurance Appeals Tribunal public website.
