The Consent and Capacity Board (CCB) seeks candidates who are interested in being appointed as a part-time Lawyer Member.
The CCB is an independent adjudicative tribunal created under the Health Care Consent Act. The board receives its adjudicative authority from the Health Care Consent Act, the Mental Health Act, the Substitute Decisions Act, the Personal Health Information Protection Act, the Child, Youth and Family Services Act, and the Mandatory Blood Testing Act. The CCB’s mandate is to adjudicate on matters of capacity, consent, civil committal, substitute decision-making and other issues affecting citizens of Ontario, the health care community and other government agencies. The CCB is responsible for holding hearings and making decisions in accordance with the legislation and relevant case law.
A Lawyer Member:- Respectfully conducts hearings in accordance with the governing statute and other applicable laws as well as within the policies, procedures and rules of practice developed by the Consent and Capacity Board.
- Presides over hearings in a way which is fair, dignified, inclusive, professional, and respects the rules of natural justice.
- Issues written Decisions and/or Endorsements and/or Reasons for Decision.
- Participates fully in deliberations by finding the facts from the evidence, then applying the law to those facts.
- Issues clear, well-written, soundly reasoned Decisions, Endorsements and Reasons for Decision, which are understandable and can be implemented by the parties.
- Fulfills the roll of presiding member by chairing the hearing, maintaining firm control over the hearing and issuing timely Decision and/or Reasons for Decision.

The Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009 provides that all appointments shall be made through a competitive, merit-based process.
Lawyer Members are required to have the following abilities, skills and knowledge in order to carry out their responsibilities effectively:- Experience in interpreting and applying legislation with specific knowledge of the Mental Health Act, Health Care Consent Act, Substitute Decisions Act, Personal Health Information Protection Act, Mandatory Blood Testing Act, the Child, Youth and Family Services Act and Statutory Powers Procedure Act.
- Understanding of the professional, institutional and community context within which the board operates.
- Demonstrated analytical, conceptual, problem-solving, decision-making skills.
- Well-developed writing skills.
- Ability to listen and communicate clearly and effectively.
- Ability and willingness to travel within the province on short notice (i.e. 24 hours).
- Good standing with the Law Society of Ontario.
- Computer literacy.
Prior to the interview potential candidates will be required to complete sample Reasons for Decision, within the legislated timeframe (4 business days) and present the Reasons to the interview panel.
Indigenous candidates and those who have demonstrated experience in working with Indigenous individuals and communities are strongly encouraged to apply.
In addition, pursuant to the French Language Services Act, the organization has a statutory obligation to ensure that French services are provided in a manner that is clearly visible, publicized, easily accessible and of equivalent quality to those offered in English. Every person that comes before the board has a right to communication in French and to receive available services in French. As such, the Consent and Capacity Board is actively seeking candidates who are able to conduct hearings, communicate as necessary and adjudicate in French. Bilingual (French and English) candidates are strongly encouraged to apply. Successful bilingual candidates may undergo an assessment to determine language proficiency and ability to deliver French Language Services.

Appointment is by Order in Council for an initial period of up to two years and is subject to renewal for a maximum of 10 years in a given position, upon the recommendation of the Chair. - Time Commitment

Will be variable depending on caseload and member's availability. A minimum expectation is four days per month. - Expenses

Lawyer members are eligible to receive $918 per day. Appointees will receive reimbursement for reasonable expenses in accordance with the Management Board of Cabinet's Travel, Meal and Hospitality Expenses Directive.
