Function:  The board functions as a quasi-judicial adjudicative tribunal authorized to hold hearings and conduct reviews respecting appeals against the decision of: the General Manager of OHIP; insured health services and practitioner billing; community placement services regarding eligibility for placement in a long-term care facility; community-based long term care service providers regarding the scope and level of services provided; the Minister and ministry officials regarding health facility licensing and municipal health boards' compliance with mandatory programs; and public health officials regarding community health hazards and communicable diseases.

The Transitional Physician Audit Panel functions as a quasi-judicial adjudicative tribunal, an alternative process by which a physician can seek a review of certain matters pursuant to section 18.0.1 of the Health Insurance Act. This panel of the Health Services Appeal and Review Board is authorized to hold hearings and conduct reviews of opinions or decisions of the General Manager of OHIP with respect to OHIP payments.

Membership:  The Lieutenant Governor in Council appoints to the Health Services Appeal and Review Board at least twelve members and designates one member as chair and two members as vice-chairs. The chair may from time to time designate additional members to be vice-chairs. No more than three legally qualified medical practitioners may be appointed to the board.

For the Transitional Physician Audit Panel, the Lieutenant Governor in Council appoints at least nine members and designates one member as chair and two members as vice-chairs pursuant to subsections 7.1(2) and (4) of the Ministry of Health Appeal and Review Boards Act, 1998. The chair may from time to time designate additional members to be vice-chairs. The Lieutenant Governor in Council, on the recommendation of the Minister of Health and Long-Term Care and in consultation with the Ontario Medical Association and the College of Physicians and Surgeons of Ontario, shall appoint no fewer than six legally qualified medical practitioners. In addition, no fewer than three members of the Law Society of Upper Canada shall be appointed to serve as members of the Transitional Physician Audit Panel. Members of the Transitional Physician Audit Panel shall not otherwise sit as members of the Health Services Appeal and Review Board.

Term:  There is no limitation in legislation.

Meetings:  Board members must commit a minimum of one day each month for hearings and one day per month for Board business meetings. Typically, a hearing requires a half day of preparation. Post-hearing decision work requires one member of the panel of three to write the decision; depending on the complexity of the case, decision writing may take a half-day to four days. The other two members of the panel review, edit, and comment on the decision (an average of two hours of work). All proceedings are held in Toronto.

Requirements:  A person may not be appointed as a member of the board if the person is employed under Part III of the Public Service of Ontario Act, 2006 or is employed by a Crown Agency as defined in the Crown Agency Act, 2006.

A legally qualified medical practitioner who was subject to a review by the Medical Review Committee or who was required to reimburse the Plan under the Health Insurance Act may not be appointed under subsection (2) until at least 10 years have passed since he or she was subject to review by the Medical Review Committee or was required to reimburse the Plan.
