Function: The commission, a self-financing agency, is responsible for governing and regulating thoroughbred and standardbred horse racing in Ontario. It licences all racetrack operators as well as those who work at the tracks or participate in racing. Under the Racing Commission Act, it has the power to suspend violators, or to impose and collect fines, should participants breach the rules of racing established in Ontario.
Membership: The Lieutenant Governor in Council appoints not fewer than three and not more than seven members and designates one of the members as chair and one as vice-chair. If the chair is absent or otherwise unable to act or if the office is vacant, the vice-chair shall act in the place of the chair.
Term: There is no limitation in legislation.
Meetings: There are about twenty meetings per year. As well, commissioners are required to sit on hearings from time to time. There are about fifty-five to sixty hearings per year which require a panel of one or more members.
Requirements: The member will be responsible for the adjudication of appeals by licensees in accordance with the Racing Commission Act, 2000 and the Statutory Powers Procedure Act. In carrying out this responsibility, the member will prepare for hearings, conduct hearings and make rulings and/or write decisions. In preparing for the hearing, the member will review materials submitted by parties. The member will conduct hearings as assigned by the Chair, in accordance with the Act and other applicable laws and with the policies, procedures and rules of the Commission. The member will make rulings and decisions on the basis of evidence and submissions and issue decisions in a timely manner. The member will also participate in monthly Commission member meetings to fulfill the Board's operational responsibilities and when requested to do so by the Chair or the Chair's designate, in training and mentoring sessions. Every member is assigned to a role on a committee. Appointees are required to have the following abilities, skills and knowledge in order to carry out their responsibilities effectively: Demonstrated analytical, conceptual, problem-solving and writing skills; ability to listen and communicate clearly and effectively; computer literacy; good organization skills; ability to objectively and fairly assess cases involving difficult issues regarding conflicting verbal/written evidence and the assessment of credibility; willingness to travel throughout the province occasionally for the purpose of attending racing functions; self-confidence; understanding of the justice system and the role of administrative tribunals in that system; expert knowledge of the Commission's governing Act and related law or the ability to acquire such expert knowledge; and understanding of the racing industry, the culture, the public relationship and the professional, institutional and community context within which the Commission operates. Annually, the Board measures its performance on the basis of stewardship, integrity/ethics/values, knowledge and skills, agency governance, strategic leadership, external relationships and adjudication.
