Function:  The functions of the Council are a) to monitor and report to the people of Ontario on access to publicly funded health services, health human resources in publicly funded health services, consumer and population health status, and health system outcomes; and b) to support continuous quality improvement.

Membership:  The Council shall have no fewer than nine and not more than 12 members who shall be appointed by the Lieutenant Governor in Council. One of the members shall be the Chair of the Council, and one of the members shall be Vice-Chair, as provided for by the Lieutenant Governor in Council. Where there is in existence a similar council for Canada and the provinces and territories of Canada, at least one of the members of the Council shall be a person who is from Ontario and sits on the similar council.

Term:  Members of the Council hold office for a term of three years and may be re-appointed for one further term. Of the initial appointments, as nearly as possible, one-half shall be appointed for a term of two years; and one-half shall be appointed for a term of three years. The person appointed under subsection 2(6) of the Act shall hold office for the duration of the term of his or her appointment on a similar council for Canada and the provinces and territories of Canada. If a person ceases to be a member of the Council, the first term of appointment of the person appointed to succeed that person may only be for the remainder of the first person's term.

Meetings:  The Council shall meet regularly throughout the year at the call of the Chair, and, in any event, at least four times a year.

Requirements:  In appointing the members of the Council, regard shall be had to the desirability of appointing a) experts in the health system in the areas of patient and consumer issues and health service provision; b) experts in the area of governance, accountability and public finance; and c) persons from the community with a demonstrated interest or experience in health service. In addition to these considerations, in appointing members of the Council, regard shall be had to representing the diversity of the population of Ontario and expertise with particular groups. A person who is a member of the Board or the chief executive officer or an officer of a health system organization may not be a member of the Council.
