Function:  The board has exclusive jurisdiction to determine all applications under and with respect to matters regarding residential tenancies whose jurisdiction is defined in the Act. It has the authority to hear and determine all questions of law and fact with respect to matters within its jurisdiction under the Act. A landlord or tenant may apply to the board for an order determining whether the Act or any provision of it applies to a particular rental unit or residential complex or any other prescribed manner. On receipt of an application, the board makes findings and makes the appropriate order.

Membership:  The members of the board are appointed by the Lieutenant Governor in Council. One of the members of the board is appointed as chair and one or more members are appointed as vice-chairs, by the Lieutenant Governor in Council. The chair is the Chief Executive Officer of the board. The chair may designate a vice-chair to exercise the powers and perform the duties of the chair when he or she is absent or unable to act.

Term:  If the term of office of a member of the board who has participated in a hearing expires before a decision is given, the term shall be deemed to continue for four weeks, but only for the purpose of participating in the decision and for no other purpose.

Meetings:  Regional meetings of board members are held on a quarterly basis to discuss matters of adjudicative concern, and four days per year are set aside for all board members for province-wide professional development.

Requirements:  The member will be responsible for the adjudication of disputes between parties appearing before the board pursuant to the governing Act. In carrying out this responsibility, the member will prepare for hearings, conduct hearings and make rulings and/or write decisions. The member will conduct hearings as assigned by the Chair, in accordance with the Act and other applicable laws and with the policies, procedures and rules of the board. The member will make rulings and decisions on the basis of evidence and submissions and issue decisions in a timely manner. In preparing for the hearing, the member will review the application and any related supporting materials submitted by parties. The member also identifies opportunities where alternative ways of resolving the dispute are suitable. The member will also participate in board member meetings, and when requested to do so by the Chair or the Chair's designate, in training and mentoring sessions and in committees established for the administration of the board's adjudicative role. Appointees are required to have the following abilities, skills and knowledge in order to carry out their responsibilities effectively: Demonstrated analytical, conceptual, problem-solving and writing skills; ability to listen and communicate clearly and effectively; computer literacy; good organization skills; well-developed dispute resolution skills; ability to objectively and fairly assess cases involving difficult issues regarding conflicting verbal/written evidence and the assessment of credibility; willingness to travel throughout the province for the purpose of conducting hearings; self-confidence; understanding of the justice system and the role of administrative boards in that system; expert knowledge of the board's governing Act and related law or the ability to acquire such expert knowledge; understanding of the professional, institutional and community context within which the board operates; demonstrated interest in professional development; strong interpersonal relations; collegiality; stamina and stress resistance. Vice-chairs will also need to demonstrate competencies in leadership and results-orientation skills.
